tag has or had been placed, taking a photograph(s) as set forth below. There
will be approximately 8,000 (eight thousand) Travel Bugs initially placed at
locations throughout the 48 contiguous United States and District of Columbia.
The longitude and latitude of those locations will be posted at
www.geocaching.com. To see the list of locations, access that web site and then

entry they will be notified that their submission is under review for appropriateness.
If a participant finds a Travel Bug and that participant relocates the Travel
Bug, (any such location must be in 48 contiguous U.S./DC), as a courtesy to
fellow participants, the participant is asked to record the cache listing of
the Travel Bug’s new location and then access www.geocaching.com
and log the new geocache location of the relocated Travel Bug by following the
instructions on www.geocaching.com/track.
If a participant does not find a Travel Bug visit jeep.geocaching.com
and visit the cache page for the location where the Travel Bug was supposed to
have been located. Then click on the link to the Travel Bug web page where
the participant can click on the “Submit Contest Photo” and follow the on-line
directions to submit a photo(s) entry. Once an entry has been submitted,
participant will be notified that the submission is under review for appropriateness.
Themes:
For
each of the Initial Judging Periods there will be one theme established. Each
theme will be an element which must be included in the photograph (if the photograph includes
a Travel Bug) or may appear in a 2nd photograph if the 1st
photograph shows the location where the Travel Bug was placed, by including a
GPS unit in the 1st photograph with the latitude and longitude of
the location clearly visible on the GPS unit. The various themes/elements may
be specific objects, or may be more broadly defined and left to the imagination
of the participant. Some themes may be available at the location at which the
initial photograph may be taken, some may be brought to the location, or some
may require additional travel to a second location. The theme for each month
will be posted at jeep.geocaching.com no later than 12:00:01
a.m. (ET) on the first day of each Initial Judging Period.
The Photograph: There are 2 types of photographs which
will qualify, photographs with the Travel Bug and photographs without the
Travel Bug:
(a) Photographs With the Travel Bug When Travel Bug
Found At Location: Photographs with the Travel Bug must picture the Travel
Bug either at the location, or at a different location, but in either case must
also include in the same photo the theme for the Initial Judging Period theme
in which the photo will be entered.
(b) Photographs Without the Travel Bug When Travel Bug
Not Found At Location: If there is no Travel Bug at the location then
the photograph must show the GPS unit with the latitude and longitude of the
location clearly visible on a GPS unit. If the theme is at the location then
that theme can also be included in the photo. If the theme is not at the
location then a 2nd photo at such a place where the theme may be
photographed must be taken.
Photograph
Specifications: While the photo may be taken digitally
or on film, only digital submissions will be accepted, so if a photo is taken
on film it must be converted to a digital format for submission. For
submission, the photograph must be in JPEG (.jpg) or TIFF (.tiff) format,
cannot exceed 4 MB in size, and cannot have been manipulated, for example but not limited to, brightness or
hue or contrast adjusted, sharpened or cropped, enhanced, morphed, or retouched
(in any manner whatsoever).
About
Entries: When your
entry is received and recorded by the Contest Data Base you will receive one
entry into the Contest. Entries for any Initial Judging Period must be
received and recorded by the Contest Data Base during that Period, and the
photo(s) for that Period must contain the theme for that Period. No other form
of participation is valid; no mail-in entries will be accepted. Limit one
entry per person/email address/log-on/user name/password/ Geocaching.com
account per Initial Judging Period. Any attempt by any participant to obtain
more than one (1) entry per Initial Judging Period by using multiple/different
email addresses, identities, log-on/user names and passwords, Geocaching.com
accounts or any other methods will void that participant’s entries and that
participant will be disqualified. A participant may only use one location
and/or Travel Bug per entry. Any attempt by any participant to use the same
location and/or Travel Bug in multiple entries will void all such entries.
Proof of submission or sending an entry is not proof of receipt by Sponsor.
All entries become the exclusive property of Sponsor, and will not be
acknowledged or returned. Any entry which Sponsor, in its sole opinion, deems
to be inappropriate for publication will not be considered. An entry can
neither name, depict, nor describe, any person, living or dead, (except as
provided in these Official Rules), nor can an entry contain the trademark, trade
name, or logo (other than the trademark, trade name, or logo on a GPS unit,
[which trademark, trade name, or logo Sponsor and/or judges may fuzz, blur or
otherwise distort when the entry photograph is posted on the web site, but any
such fuzzing, blurring or distortion will have no effect on the entry’s ability
to participate or win]), or a Jeep trademark, trade name, or logo), or
copyrighted material, of any person or entity.
Use of
Photos: By
submitting an entry photo entrant (and entrant’s parent/legal guardian,
if participant is a minor) grants a license to post his/her entry photo (or any
part thereof) and/or use his/her name on the web site,
jeep.geocaching.com
or any other web site related to the Contest, at any time or times, as
is consistent with the Official Rules, and entrants shall have no right of
notice, review or approval of any such use of the entry photo and/or entrant’s
name, and acknowledges and agrees that the entry photo (or any part thereof)
and/or his/her name may be used in whole or in part, alone or in combination
with other works, and that the entry photo may be changed, altered, edited or
modified, used in distorted, illusory or composite form, or in any other
manner, as solely determined by Sponsor. Further, entrant (and participant’s
parent/legal guardian, if participant is a minor) warrants and represents that
entrant has received all rights, releases and permissions which may be
necessary from any person depicted, described or identified in the entry photo,
and/or the photographer of the entry photograph to grant this license for the
use stated.
By entering, each entrant (and his/her parent/legal
guardian if entrant is a minor) represents and warrants
that entrant’s entry:
(i) is the sole, exclusive, and original creation of
the entrant and has not been copied in whole or in part from any other work;
and,
(ii)
does not violate or infringe any copyright, trademark/trade name, logo, or
intellectual property right, other proprietary right of any person (including
but not limited to rights of privacy or publicity or portrayal in a false
light), or entity; and,
(iii) is the sole and exclusive property of the
entrant; and,
(iv) has not been published, or submitted in any
other competition; and,
(v) is truthful in all respects,
and accurately depicts and describes the facts and geocaching experience of the
entrant.
Sponsor
will not respond to any questions about an entry or the Contest. Once an entry
is submitted, it cannot be changed, altered or modified.

Posting
and Voting: By
submitting an entry, entrant (and entrant’s parent/legal guardian if entrant is
a minor) gives permission to Sponsor to post his/her entry on the World Wide
Web in accordance with the requirements of this Contest. Entries for each
particular Initial Judging Period will be posted at jeep.geocaching.com.
Because the sharing of the geocaching experience is a part of the geocaching
community, visitors to the site may view the entries and will be asked to vote
for the entries posted for the photo that best reflects/expresses the
geocaching experience. To vote you must have or create an account on Geocaching.com.
If you do not have an account, follow the web site’s directions to create the
account.
To vote
a voter must first access jeep.geocaching.com and then click on the
icon, banner or text link to access the Photo Gallery, view the photos and
vote. Voters need not be Contest participants to vote. A visitor may only
vote for one entry for any Initial Judging Period. Once a visitor votes for an
entry, and submits that vote as directed, he/she may not change his/her vote.
Any attempt by any voter to obtain more than one (1) vote for any Initial
Judging Period by using multiple/different email addresses, log-on/user names
and passwords, Geocaching.com accounts, identities or any other methods will
void all of that voter’s votes and that voter will be disqualified from further
voting.
4. INITIAL
JUDGING PERIOD JUDGING:
All eligible entries for each Initial Judging Period will be judged by a panel
of judges composed of one judge each from Sponsor (or its designee)
Groundspeak, Inc., and Rodale Inc. Entries will be judged on the following
criteria with up to twenty five (25) points available for each criterion: (a)
Applicability to, and depiction of, Geocaching Experience, (b) Creativity, and
(c) Humor. Up to twenty-Five (25) points will also be available for the voter
portion of the Contest. Six potential Finalists (1 per Initial Judging Period,
all of whom will receive First Prizes) will be determined by highest cumulative
scores for all criteria awarded by the judges (and the voting) for that Initial
Judging Period. Thirty potential Runner Ups (5 per Initial Judging Period, all
of whom will receive Runner Up Prizes) will be determined by next highest
cumulative scores for all criteria awarded by the judges (and the voting) for
that Initial Judging Period. In case of a tie, tied entries will be broken by
cumulative scores awarded for Applicability to, and depiction of, Geocaching
Experience. If tie continues, then ties will be broken by the entry with
highest cumulative scores in Applicability to, and depiction of, Geocaching
Experience, and Creativity. If tie cannot be broken, tied entries will be
evaluated by a new judge according to original criteria, and tied entry with
highest cumulative score by the new judge (and the voting) will be declared a
potential Finalist. Potential Finalists for each Initial Judging Period will
be determined on or about the above stated “Winner Chosen” date for that
Initial Judging Period from all eligible entries received for that Initial
Judging Period.
5.
FINALIST JUDGING: The
potential six (6) Finalists will each be notified by regular or express mail,
and will be required to complete, sign and return within a specified time an
Affidavit of Eligibility, a Liability Release, and where lawful, a Publicity
Release and may further be required to provide additional documents, such as
but not limited to releases from any and all persons depicted in the entry
photograph and/or the photographer of the photo. If Finalist is not the age of majority in his/her
jurisdiction of residence (“a minor”), prize may be awarded in name of, or to,
Finalist’s parent/legal guardian who must execute all documents and agree to
all obligations and undertakings of Finalist, both on behalf of Finalist and
himself/herself, or prize may be forfeited and awarded to an alternate. If Affidavits/Releases and/or additional
documents and releases are not received by the date stated on the notification,
or if any notification is returned as non-deliverable, or if a potential
Finalist is found to be ineligible or not in compliance with these Official
Rules, the potential Finalist will be disqualified. Only the potential
Finalists who have complied with the foregoing requirements will be judged by a
second panel of judges. The second panel of judges will be composed of one
judge each from Sponsor (or its designee) Groundspeak, Inc., and Rodale Inc.
Finalist entries will be judged on the criteria stated in Rule #4 (but not the
voting) with 33 1/3 points available for each judged criterion, and the
Finalist with the highest cumulative score awarded for all criteria, will be
determined to be the Grand Prize winner. The Grand Prize Winner will also be
awarded a First Prize. In case of a tie, the tied entries will be broken using
the tie-breaking parameters stated in Rule #4. The Grand Prize winner will be
determined on or about 2/29/08, and will be notified by regular or express
mail, on or about 3/5/08.
6.
PRIZES: (1) Grand
Prize: 2008 Jeep Liberty. Estimated MSRP $29,000. Vehicle will be delivered
with standard equipment for make and model; available upgrades and options are
at the sole expense of the winner. Winner will be required to show proof of

winner’s residence. Winner must pick up vehicle within 45 days of notification
that vehicle is available, or prize may be forfeited, and an alternate winner

fair market value of the prize will be filed and a copy provided to Winner. (6)

Initial Judging Period) a Jeep Memory stick, a Geocaching T-Shirt and a Jeep

stated related to acceptance and use of a prize are solely the responsibility
of the winner. If winner cannot accept prize as stated prize will be forfeited
in its entirety and awarded to an alternate winner. Any difference between the
stated and actual value of prize will not be awarded. No substitution, cash
redemption or transfer of prize, but Sponsor reserves right to substitute prize
with prize of equal or greater value if advertised prize becomes unavailable.
Limit one (1) First Prize or Runner Up Prize per participant for the entire
Contest.
7. General Conditions: By participating, Participants (and participant’s
parent/legal guardian, if participant is a minor) agree (a) to these Official
Rules and the decisions of Sponsor and judges, which decisions shall be final;
(b) that Sponsor, Rodale Inc., Alcone Marketing Group, BBDO Detroit,

subsidiaries and affiliated companies, advertising and promotion agencies, and
all of their respective officers, directors, employees, representatives and
agents (individually and collectively “Releasees”) are released, will have no
liability whatsoever for, and shall be held harmless by participants (and a
participant’s parent/legal guardian, if participant is a minor) against any
liability for any injuries, losses or damages of any kind to person(s),
including death, or property, or intellectual property, or rights of publicity or privacy,
defamation, or portrayal in a false light, resulting in whole or in part, directly or indirectly, from
acceptance, possession, misuse or use of the prize or participation in this
Contest and (c) winners (and winner’s parent/legal guardian, if winner is a

name, picture, voice and/or likeness, biographical information and statements
and prize information, and entry photo(s) (and notwithstanding anything to the contrary
in these Official Rules license the use of the entry to Sponsor, which may be
altered, changed, modified, edited, used alone, together or with other works,
and/or used in distorted, illusory or composite form, as solely determined by Sponsor) for advertising, trade and promotional
purposes without further compensation, at any times or time, in all media now
known or hereafter discovered world wide, and on the Internet and/or World Wide
Web, without notice or review or approval.Participants (and participant’s
parent/legal guardian, if participant is a minor) acknowledge that no
representation or warranty, written or oral, express or implied, in law or in
fact is made for any prize except only that which may be made for that prize in
the limited written warranty, if any, provided with that prize by the
manufacturer of that prize. Each winning entry will be deemed a Work Made For
Hire under the Copyright laws of the United States, but if it cannot be so
deemed, then each winner (and each winner’s parent/legal guardian, if winner is
a minor) irrevocably sells, assigns and transfers to Sponsor all of his/her
right, title and interest in and to his/her entry, including but not limited to
all copyright and trademark rights, in the United States and worldwide,
therein, for valuable consideration, the receipt and sufficiency of which is
hereby acknowledged. Winners (and each winner’s parent/legal guardian, if
winner is a minor) hereby waive in favor of Sponsor, all rights of “Droit
Moral” or “Moral Rights” or any similar rights or principles of law that
winners may now or later have in the entry. Upon request of Sponsor, winner
(and each winner’s parent/legal guardian if winner is a minor) shall execute
and deliver such additional instrument of sale, transfer and assignment, as may
be solely deemed by Sponsor, reasonably necessary to establish the ownership of
record of the right, title and interest in and to the entry and of the
copyrights transferred hereunder, and the waiver of all rights of “Droit Moral”
or “Moral Rights” or any similar rights or principles of law; and to record and
perfect same. Should Sponsor fail to request the said assignment as stated,
that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a
later time request the transfer and/or assignment.

the failure to capture, or loss of, any such information. Persons who tamper
with or abuse any aspect of this Contest, as solely determined by the Sponsor,

computer related to or resulting from participating in this Contest or
downloading materials from or use of the web site. Should any portion of the
Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs,
non-authorized human intervention, technical failures or other causes which, in
the sole opinion of the Sponsor, corrupt or impair the administration,
security, fairness or proper play, or submission of entries, Sponsor reserves
the right at its sole discretion to cancel or terminate the Contest, and select
the winners from entries received prior to action taken or as otherwise deemed
fair and appropriate by Sponsor; and notice thereof will be posted on the web
site. Releasees are not responsible for any incorrect or inaccurate
information however caused. In case of dispute, the authorized subscriber of
the email account used to enter the Contest at the actual time of entry will be
deemed to be the participant who must comply with these Official Rules.

for any damages or losses of any kind, including direct, indirect, incidental,
consequential or punitive damages arising out of your access to and use of the
web site or downloading from and/or printing material downloaded from said web
site. Without limiting the foregoing, everything on this web site is provided “as is” without warranty of
any kind, either express or implied, including, but not limited to, implied
warranties of merchantability, fitness for a particular purpose or
non-infringement. Some jurisdictions may not allow
